XPERIENCE is an edtech company specialized in augmented reality. We were born with the goal of transforming education through the use of immersive technologies, we are committed to the technological development of education and even more so with your privacy! Therefore we demonstrate and explain, through this Privacy Policy, our commitment to the security and treatment of your personal data, always in compliance with applicable laws.

Please read this Privacy Policy and if you do not agree with any or all of the terms described herein, we request that you do not access, browse or use the platform. 

When browsing our platform, informing your personal data or interacting with us in any other way, you agree with this Privacy Policy, which adopts the following definitions:

DEFINITIONS

PRIVACY POLICY: is this document that explains how XPERIENCE handles the DATA in our activities.

XPERIENCE: is the company XPERIENCE TECNOLOGIA E SERVIÇOS DIGITAIS LTDA., enrolled with CNPJ nº 39.646.458/0001-58, with address at Rua Afonso Braz, nº 644, Vila Nova Conceição, São Paulo/SP, CEP 04.538-133.

PROCESSING: is all the actions performed by XPERIENCE with the DATA of a REGISTER, including, for example, the collection, registration, storage, sharing, use, transmission, deletion, among others.

PERSONAL DATA: any information related to a REGISTER that can identify him/her or information that, when used together, can identify the REGISTER (name, identification numbers such as RG, CPF, affiliation, address, profession, etc.). For the purposes of this PRIVACY POLICY, PERSONAL DATA is referred to simply as DATA.

SENSITIVE PERSONAL DATA: any PERSONAL DATA about racial or ethnic origin, religious belief, political opinion, membership of a trade union or religious, philosophical or political organization, data concerning health or sex life, genetic data, biometric data, when linked to a REGISTER. XPERIENCE does not process SENSITIVE PERSONAL DATA on the PLATFORM.

NON-PERSONAL DATA: any data not related to a SUBSCRIBER or data that, due to anonymization, cannot be associated directly or indirectly to a SUBSCRIBER.   

TITLE-holder: is the natural person (natural person) to whom the DATA is related.

PLATFORM: is the set of tools and services made available on the www.xperiencexr.com domain and associated subdomains, as well as on the XPLabo application for mobile devices (IOS and Android).

COOKIES: are small files transferred to the electronic device that a SUBSCRIBER uses to access the XPERIENCE PLATFORM, which allow the identification of details of the access made, but not a SUBSCRIBER directly.

CONTROLLER: is the individual or legal entity with the decision power concerning the DATA PROCESSING. 

OPERATOR: is the individual or legal entity that processes the DATA on behalf of the controller;

LEGAL BASIS: is the legal authorization that XPERIENCE has to process the DATA of a Data Controller. 

WHAT DATA DOES XPERIENCE COLLECT?  

Depending on the relationship of the OWNER with XPERIENCE, we may collect the following data: Name, email, phone number, state, city, educational institution and job title.

The DATA is used for the purpose of the REGISTERER’s registration on the PLATFORM, for contact and also for the execution of the contract between the REGISTERER and XPERIENCE. 

IN WHAT SITUATIONS CAN XPERIENCE HANDLE MY DATA?  

XPERIENCE may process your DATA when 

– the DATA is provided directly by the OWNER as a result of contact with XPERIENCE, whether by email, through the PLATFORM, participation in events and others;

– the DATA is available from public databases of government authorities; 

– the DATA is made public by the OWNER; 

– the DATA is required for contract execution, including preliminary procedures to the contract;

– the DATA is necessary for the proper exercise of XPERIENCE’s rights in judicial, administrative or arbitration proceedings;

– the DATA is necessary for the legitimate interest of XPERIENCE, as DATA controller, or a third party, respecting the fundamental rights and freedoms of the Data subject; 

– the DATA is provided automatically through COOKIES and similar technology.

DOES XPERIENCE SHARE MY DATA?

XPERIENCE only shares the DATA when strictly necessary.

Sharing may occur when the DATA is required by a public authority or when XPERIENCE is complying with a legal or regulatory obligation.

Additionally, the sharing of DATA may occur with service providers because of the operationalisation, including execution and improvement, of XPERIENCE activities. In these cases, XPERIENCE provides the service providers with contractual responsibilities for the security of the information and protection of the OWNER’s DATA.

WHAT ABOUT CHILDREN AND TEENAGERS’ PERSONAL DATA?

The DATA of children and adolescents is handled by XPERIENCE in accordance with the provisions contained in this PRIVACY POLICY, always in the best interests of children and adolescents and as permitted by law.

All children and adolescents are guaranteed the rights of the DATA SUBJECT mentioned in section 9 of this PRIVACY POLICY.

DOES XPERIENCE TRANSFER MY DATA TO OTHER COUNTRIES?

XPERIENCE is a company with headquarters and operations in Brazil and may contract service providers located abroad for storage purposes, transferring DATA to other countries. In this case, XPERIENCE complies and requires its service providers to process the DATA in accordance with the applicable legislation.

HOW IS MY DATA PROTECTED?

XPERIENCE adopts technical and administrative security measures to protect your DATA. This includes the use of technological resources available in the market related to information security, such as antivirus, firewall, SSL (Secure Socket Layer) and internal procedures that ensure access control only by authorized persons in order to protect the REGISTER’S DATA from unauthorized access and accidental destruction, loss, alteration, communication or any form of inappropriate or unlawful treatment. 

WHAT ARE MY RIGHTS AS A DATA SUBJECT?

The Data Subject may, at any time, request from XPERIENCE

– The confirmation of the existence of DATA PROCESSING;

– To access the DATA;

– to correct any DATA that is incomplete, inaccurate or out of date;

– The anonymisation, blocking or erasure of DATA which is unnecessary, excessive or processed in breach of the law;

– The portability of the DATA to another service or product provider on express request, in accordance with the regulations of the national authority, with due observance of commercial and industrial secrets;

– The elimination of the DATA processed with your CONSENT;

– The information of the public and private entities with whom XPERIENCE has shared the DATA;

– The information on the possibility of not providing CONSENT and the consequences of refusal;

– The revocation of the CONSENT at any time by express request, in a simple and free manner.

CAN THIS PRIVACY POLICY CHANGE? HOW DO I STAY INFORMED?

The XPERIENCE PRIVACY POLICY may be modified at any time. Any material modification to this PRIVACY POLICY will be communicated to you and will be available on the PLATFORM for your information.

Through the XPLabo application you can explore contents in augmented reality providing a more participative, fun and interactive teaching and learning process. 

These terms of use (“Terms”) govern your relationship with XPERIENCE when using the XPLabo application (“Application”), available for IOS and Android.

The App is offered for educational purposes.
XPERIENCE reserves the right, at any time, to improve, correct and update the information provided in the Application.
The information in the Application is produced by XPERIENCE. 
All material found in the Application, including text, images, audio, software, technology, logos, slogans, trademarks, advertising statements, domains, trade names, intellectual works, etc., are the property of or licensed to XPERIENCE, and any reproduction, even partial, is prohibited under penalty of applicable law and damages.
You agree to use the Application in good faith for lawful purposes and to refrain from any use that would compromise the full or partial functionality of the Application.

These Terms may be updated by XPERIENCE at any time. If there are material changes, XPERIENCE will provide you with notices and the updated Terms on the Application and you are responsible for reviewing and accepting them.
